ELIGIBILITY: JetBlue "The Ultimate Big Papi Experience" Sweepstakes (the "Sweepstakes") is open only to legal residents of fifty (50) United States (excluding Alaska and Hawaii) and the District of Columbia, who have reached the age of the majority in the jurisdiction within which they reside on the date of entry. Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of JetBlue Airways Corporation, (the "Sponsor" or "JetBlue"), Centra Marketing & Communications ("Sweepstakes Headquarters") the MLB Entities and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Sweepstakes ("Related Entities") are not eligible to participate or win a prize. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. The Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. Void outside the fifty (50) United States, the District of Columbia and where prohibited and restricted by law, rule or regulation.
HOW TO ENTER: The Sweepstakes begins at 12:01 AM Eastern Daylight Savings Time ("EDST") on June 22, 2009 and ends at 11:59:59 PM EDST on July 20, 2009 ("Entry Period"). There are two ways to enter: online, or by mail. No other method of entry will be accepted. Limit one (1) entry per person/per valid e-mail address, regardless of method of entry.
1. Online Method: During the Entry Period go to www.redsox.com/jetblueultimatepapiexperience and click on the Sweepstakes banners, buttons and/or links to access the online entry form for the Sweepstakes. By successfully transmitting a completed online entry form as directed, you will be entered in the Sweepstakes. All information submitted online by entrants is subject to, and will be treated in a manner consistent with, the Redsox.com Terms of Use accessible at: http://mlb.mlb.com/bos/help/bos_help_about_terms.jsp and Privacy Policy accessible at: http://mlb.mlb.com/bos/help/bos_help_about_privacy.jsp. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Incomplete entries are void. Online entrants to the Sweepstakes may be given the option to receive (a) commercial e-mails from Sponsor, MLB.com and/or Redsox.com, and/or (b) mobile text messages and updates from MLB.com; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such emails or mobile text messages and updates. 2. Mail-in Method: If you do not wish to enter online, you may enter the Sweepstakes by hand-printing your full name, address, city, state and zip code, day & evening telephone numbers (including area code), date of birth and e-mail address (optional) on a 3"x 5" piece of paper and mailing it in an envelope with First Class postage affixed to: JetBlue Airways "The Ultimate Big Papi Experience" Sweepstakes, c/o Centra Marketing & Communications, LLC. 1400 Old Country Road, #420, Westbury, NY 11590. Sponsor will use e-mail addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's provision of this information. Mail-in entries must be postmarked by July 20, 2009 and must be received by July 27, 2009 to be eligible. Mail-in entries become the property of the Sponsor and will not be acknowledged or returned.
RANDOM DRAWING: Five (5) entries will be selected at random from among all entries received. Subject to verification of eligibility, the persons whose entries are so selected will be declared the "Prize Winners" (each, a "Prize Winner" and collectively, the "Prize Winners"), in the following selection order: One (1) Prize Winner of the Grand Prize ("Grand Prize Winner"), One (1) Prize Winner of the First Prize ("First Prize Winner") and Three (3) Prize Winners of the Second Prize (each a Second Prize Winner" and collectively, the "Second Prize Winners). The random drawing will be conducted by on or about August 7, 2009 by Centra Marketing & Communications, an independent judging organization, whose decisions on all matters relating to this Sweepstakes are final and binding. Second Prizes (3): A Boston Red Sox Gift Bag which consists of items designated by the Boston Red Sox (each a "Second Prize"). The ARV of each Second Prize is $100.
The ARV of all Prizes: $4,734. Travel prize values may vary depending upon point of departure and airfare fluctuations at the time of travel.
GENERAL PRIZE RESTRICTIONS: The specifics of all elements of each prize stated herein shall be solely determined by Sponsor. No transfer or cash equivalent of any prize allowed except at Sponsor's sole discretion. Prizes may not be transferred by any other means, including but not limited to sale, barter, or trade on auction websites. Prizes may not be substituted except that Sponsor in its discretion may substitute a prize, or portion thereof, with a prize or portion of comparable or greater value in Sponsor's sole and absolute discretion. Any portion of any prize not used by any winner is forfeited and no cash substitute will be offered or permitted. All prizes being offered are provided "as is" with no warranty or guarantee either express or implied by Sponsor or the MLB Entities. Merchandise prizes carry no warranty other than that offered by manufacturers. The MLB Entities and Sponsor have not made, and will not be responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Winners assume sole responsibility for all costs associated with any elements of the prizes not explicitly included as part of prize description, including without limitation, all applicable federal, state, international and local taxes (if any) or trip insurance, hotel accommodations, fees, surcharges, upgrades, meals, beverages, tips, gratuities, sightseeing or other excursions, souvenirs, ground or additional air transportation and incidentals. In the event that travel involves a connection through a JetBlue gateway city and connecting flights are not available on the same date of travel, Grand Prize and/or First Prize Winners (collectively "Travel Prize Winners") will be provided with lodging and ground transfers to/from airport in gateway city at sole discretion of Sponsor. Travel Prize air transportation is valid only for use by the Travel Prize Winner and his/her travel companion ("Guest") and no substitutions or deviations with respect to origin or destination(s) will be allowed. Travel Prize Winners and their Guests must depart on same travel itinerary and return on same travel itinerary and will be responsible for all necessary travel authorizations and travel insurance, if any. If a Guest is deemed a minor under the jurisdiction of his/her state of residence, that Guest must be accompanied by a parent or legal guardian. All Guests (or their parents or legal guardians) will be required to execute and return travel/liability releases and (where legal) publicity release prior to issuance of travel documents. No additional travel expenses or any other aspects of the Prize will be awarded should a Guest's parent or legal guardian be required to accompany Guest. Travel Prize Winners and their Guests will be solely responsible for any applicable fees, including surcharges, service charges, Passenger Facility Charges of up to $9 each way, September 11th Security Fees of up to $2.50 each way and a Federal Segment Tax of $3.50 per domestic segment (a segment is a takeoff and landing), applicable state and local taxes, insurance, and, in the case of travel to the Dominican Republic, government taxes and fees of up to $94.60 per person. Travel Prize Winners may be required to provide a valid credit card to Sweepstakes Headquarters at the time of booking flight to pay for any and all taxes and fees as stated herein on the airline tickets, if applicable. Travel Prize Winners will be required to provide a cash deposit or valid credit card at the time of hotel registration and all Travel Prize Winners will be solely responsible for any and all incidentals charged to the hotel room upon hotel check-out. Hotel accommodations are subject to availability, blackout dates and certain restrictions. Travel Prize Winners and their Guests are subject and entitled to all provisions of JetBlue's Contract of Carriage except those regarding denied boarding compensation and the Passenger's Bill of Rights. Travel is not eligible for TrueBlue points. JetBlue Airways and the MLB Entities are not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. JetBlue Schedules subject to change without notice. Travel Prize Winners and Guests must provide all necessary documents at the time of departure. JetBlue reserves the right to deny boarding to passengers without the proper documentation. Certain other JetBlue restrictions and blackout dates may apply, which may include a Saturday night stay, all of which are subject to change at the sole discretion of Sponsor. Travel is subject to availability and seats may not be available on all flights. No substitutions or deviations with respect to origin or destination will be allowed. Other restrictions apply. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner(s) and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to Winner(s) and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Released Parties (defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.
SPECIFIC PRIZE RESTRICTIONS: Grand Prize: With regard to the Boston Trip, Grand Prize Winner must select from a Sponsor-designated list of 2009 Regular Season Red Sox games. In the event that the selected Red Sox game is cancelled, delayed or moved to a different location, or the "meet and greet" session fails to take place for any reason beyond the reasonable control of Sponsor, the Sponsor will only be responsible for the travel portions of the prize and Grand Prize Winner will not be entitled to any difference or cash equivalent for the Red Sox game tickets or meet and greet session. With regard to the Dominican Republic Trip, Grand Prize Winner and Guest must have valid U.S. Passports and must travel on the following dates: depart on December 3, 2009 and return on December 6, 2009. Notwithstanding the foregoing, in the event that the Second Annual David Ortiz Celebrity Golf Classic is cancelled, delayed or moved to a different location, or the "meet and greet" session fails to take place for any reason beyond the reasonable control of Sponsor, the Sponsor will only be responsible for the travel portions of the prize and Grand Prize Winner will not be entitled to any difference or cash equivalent. In the event that the Grand Prize Winner is unable to travel to the Dominican Republic on the Sponsor-designated dates, Grand Prize Winner will forfeit that portion of the Grand Prize and no additional compensation will be provided in lieu of the travel to the Dominican Republic. First Prize: First Prize Winner must select from a Sponsor-designated list of 2009 Regular Season Red Sox games. In the event that the selected Red Sox game is cancelled, delayed or moved to a different location, the Sponsor will only be responsible for the travel portion of the prize and First Prize Winner will not be entitled to any difference or cash equivalent for the Red Sox game tickets.
WINNER NOTIFICATION/RELEASES: Each potential Prize Winners will be notified by e-mail, telephone and/or mail (in the sole discretion of Sponsor) to the address provided by each Potential Winner on his/her entry form (the "Prize Notification"). The potential Grand Prize Winner and First Prize Winners will be required to complete, sign have notarized and return, to Sweepstakes Headquarters, an Affidavit of Eligibility and Liability Release ("Affidavit") and, unless prohibited by law, a Publicity Release ("Publicity Release") within five (5) business days of date on the Prize Notification. If any potential Grand Prize Winner fails to satisfy any eligibility or verification requirements in these Official Rules, declines to accept the entire Grand Prize, is unavailable to attend both the Boston Red Sox Game and the Second Annual David Ortiz Celebrity Golf Classic or is ineligible for any other reason, he/she may be disqualified and an alternate potential Grand Prize Winner may be selected from among all remaining eligible entries provided a sufficient amount of time remains prior to the Boston Red Sox Game . Each potential Second Prize Winner will be required to complete and return a Winner Verification Form within ten (10) business days of date on the Prize Notification. If a potential First Prize or Second Prize Winner fails to satisfy any eligibility or verification requirements in these Official Rules, declines to accept the Prize, or is ineligible for any other reason, he/she may be disqualified and an alternate winner may be selected from among all remaining eligible entries. Guests of First Prize and Grand Prize Winners (or his/her parent or legal guardian if a minor under the law of the jurisdiction of his/her residence) must complete, sign, have notarized and return an Affidavit and, unless prohibited by law, a Publicity Release, prior to ticketing of prize. If the Grand Prize Winner, First Prize Winner or the Grand Prize Winner's Guest or the First Prize Winner's Guest is deemed a minor under the law of the jurisdiction of his/her residence, that Winner or Guest must also notify Sponsor of identity of the parent or legal guardian who will accompany said minor on the prize trip prior to ticketing of prize. If a Prize Notification letter or a prize is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate Potential Winner in a random drawing from among remaining eligible entries (time permitting, if applicable.) A selected potential Prize Winner will not be an official Prize Winner until his/her Affidavit and, if applicable, Publicity Release or Winner Verification Form has been returned, and eligibility has been formally verified. Sponsor is not responsible for fraudulent calls or e-mails made to Entrants or potential Prize Winners not by Sponsor or Sweepstakes Headquarters. Grand Prize Winner and First Prize Winner must supply the Sponsor with his/her social security number for tax purposes.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsor, Sweepstakes Headquarters, Related Entities, the MLB Entities and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of any Prize or any travel or activity related to the receipt or use of any Prize. Each Winner, by acceptance of Prize, grants to Sponsor, Sweepstakes Headquarters, Related Entities, MLBAM and each of their respective designees the right to publicize such Winner's name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information in any media now known or hereafter devised, throughout the world, in perpetuity, without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law.
DISPUTES: By entering the Sweepstakes, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor and/or the MLB Entities in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of New York. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of New York, County of New York, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GENERAL CONDITIONS: Released Parties are not responsible for stolen, late, incomplete, inaccurate, stolen, misdirected, lost, damaged, garbled, delayed, incomplete, postage-due or garbled entries, email or mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Prize or in any Sweepstakes-related materials, or the cancellation or postponement of any Major League Baseball game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor and/or the MLB Entities, or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, MLBAM and/or their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Notwithstanding anything in these Official Rules to the contrary, Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York.
Sponsor and MLBAM reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes (or any portion thereof) should virus, bugs, unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND MLBAM WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries generated by a script, macro or other mechanical or automated means will be disqualified. All online entries must include a valid e-mail address for the entrant. In case of multiple entries received from any person or email address or household, only the first entry received from such person or email address or household will be considered. In the event of dispute as to the identity or eligibility of any winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.
