2012 RED SOX ROAD TRIP RAFFLE (the "Raffle") OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. TRANSPORTATION TO/FROM FENWAY PARK AND HOTEL ACCOMMODATIONS NOT INCLUDED.
ELIGIBILITY: Any person of any age who is physically present at any of the 2012 Red Sox Road Trip (the "Road Trip") locations and who fills out a Raffle entry form (each an "Entry" and collectively, the "Entries") is eligible to win a Prize (defined below) for the Game Date (defined below) applicable to the corresponding state in which the person enters the Raffle. Employees, officers, and directors (including their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the Sponsor, the other MLB Entities (defined below) and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Raffle are not eligible to participate or win a Prize. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. The Raffle is subject to all applicable federal, state and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.
RANDOM DRAWING: The potential winners of the Raffle (each, a "Winner" and, collectively, the "Winners") will be selected by random drawing on or before January 26, 2012 from among all eligible Entries received by the Sponsor. The decisions of Sponsor are final and binding on all matters relating to this Raffle. Odds of winning depend upon the total number of eligible entries received by the Sponsor. Limit one (1) Prize per person, family or household.
PRIZES: A total of six (6) Prizes will be awarded as follows:
Six (6) randomly selected individuals who attend a Road Trip location and who fill out the raffle Entry form provided by the Sponsor at a Road Trip location in each of the following states and enter to win will win a Prize: Massachusetts (MA), Rhode Island (RI), Connecticut (CT), Vermont (VT), New Hampshire (NH) and Maine (ME) (each a "Winner"). Each Winner (one winner from MA, one winner from RI, one winner from CT, one winner from VT, one winner from NH and one winner from ME) will receive four (4) tickets to the corresponding Red Sox home game "State Day" scheduled to be played at Fenway Park in accordance with the chart set forth below (each a "Game Date") and shall receive a pre-game tour of Fenway Park (each a "Prize"). The Road Trip locations shall be determined in the sole discretion of the Sponsor. Exact seating locations for tickets provided in connection with a Prize shall be determined in the sole and absolute discretion of the Sponsor. At all times on the Fenway Park premises, all Sponsor guests and invitees shall be subject to the direction of Club representatives and Fenway Park security personnel. (Estimated Retail Value of each Prize: $210). TRANSPORTATION TO/FROM FENWAY PARK AND LODGING ARE NOT INCLUDED.
Each Winner is fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to lodging, all transportation costs, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of each Winner. Winner's companions must be of legal age of majority in their jurisdictions of residence, unless accompanied by a parent or guardian. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Sponsor, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Each Winner and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the Prize and with the terms and conditions on the back of the game or exhibition ticket. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to any Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or who, with intent, annoys, abuses, threatens or harasses any other person at the game, event or exhibition. The Released Parties (defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.
The Prize is non-transferable and non-assignable, with no cash redemptions except at Sponsor's sole and absolute discretion. Sponsor reserves the right to substitute a Prize (or portion thereof) with one of comparable or greater value at its sole and absolute discretion.
NOTIFICATION: The potential Winners will be notified by e-mail and/or telephone (in the sole discretion of Sponsor) and may be confirmed by postal mail, return receipt requested (the "Prize Notification"). In the event that any potential Winner does not respond to such Prize Notification within three (3) days of date of issuance, a disqualification will result and the Prize will be forfeited, at Sponsor's sole discretion and time permitting, an alternate potential Winner may be chosen from among all remaining eligible entries. The potential Winner may be required to submit his/her valid social security number and/or other identification to Sponsor and may be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Affidavit of Publicity, within five (5) days of date of issuance. Failure to submit any identification required by Sponsor or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any Prize or Prize Notification as undeliverable may result in disqualification and Prize will be forfeited and, at Sponsor's sole discretion and time permitting, may cause an alternate potential Winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Raffle and submitting an Entry, each entrant agrees to (i) be bound by these Official Rules, including all Entry requirements, and (ii) waive any and all claims against the Sponsor, the other MLB Entities and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Raffle, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Raffle or from the receipt or use of any Prize or any travel or activity related to the receipt or use of any Prize. By entering this Raffle, each entrant gives his/her express permission to be contacted by the Sponsor by telephone, e-mail and/or postal mail for Raffle purposes. Each Winner, by acceptance of Prize, grants to Sponsor and its respective designees the right to publicize such Winner's name, address (city and state of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional and/or trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.
GENERAL CONDITIONS: The Released Parties are not responsible for Entries which are stolen, lost, damaged or illegible or contain any other errors of any kind, whether human, typographical, printing, mechanical, or electronic in nature, which relate to or are connected with the Raffle (collectively, "Errors"), including without limitation Errors in Raffle-related materials or in the administration of the Raffle, such as Errors in processing Entries, determining Winners, or announcing or delivering Prizes; or if any portion of the Raffle is compromised, in Sponsor's sole judgment, by a unauthorized human intervention or other causes which, in Sponsor's sole judgment, corrupt or impair the administration, security, fairness or proper play of the Raffle, or the proper submission or capture of Entries (collectively, a "Compromising Event"), then Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the Raffle, and to select winners from all eligible, non-suspect Entries received before the known occurrence or discovery of such Comprising Event. All Entries are final and replacements will be issued by Sponsor. Sponsor has sole and final decision on admissibility of entries and the determination of Winner.
CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS RAFFLE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR AND/OR ITS RESPECTIVE AGENT RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
GOVERNING LAW; SEVERABILITY: The Raffle and these Official Rules shall be subject to and governed by the laws of the Commonwealth of Massachusetts. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all of these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law.
