OFFICIAL RULES: By participating, entrants agree to be bound by these Official Rules and by the decisions of the Red Sox Foundation, which shall be binding and final as to all matters related to the Raffle. The Raffle is subject to all applicable federal, state and local laws.

NET PROCEEDS: All net proceeds of the Raffle will benefit the Red Sox Foundation, a 501(c)3 public charity, and The Josh Beckett Foundation, a 501(c)3 public charity (hereafter known as "Sponsors") and the programs and charitable donations that Sponsors support, including recreational, educational, health and social services for at-risk children and families, and the new Home Base Program offering services for veterans with Traumatic Brain Injury and Stress Disorders.
PRIZES (19): In honor of Josh Beckett's jersey number 19, a total of 19 Prizes will be awarded in this Raffle. All prizes are "as is," with no warranty or guarantee of any kind by Sponsor, whether express or implied. Winners may not substitute, assign or transfer the Prizes or redeem the Prizes for cash or other consideration.
ELIGIBILITY TO ENTER: RAFFLE TICKETS MAY BE PURCHASED ONLY BY PERSONS 18 YEARS OR OLDER in accordance with these Official Rules and Massachusetts law. Raffle tickets may NOT be purchased by anyone under the age of 18, regardless of location or method of purchase.
Raffle tickets are available for purchase IN PERSON at Fenway Park and other select Massachusetts locations by anyone 18 years and older REGARDLESS OF HIS/HER STATE OF RESIDENCE. Raffle tickets also may be purchased on the internet ONLY BY LEGAL MASSACHUSETTS RESIDENTS WHO ARE 18 YEARS OR OLDER by following the instructions at www.redsox.com. Due to legal restrictions, residents outside of Massachusetts are NOT eligible to purchase Raffle tickets on the web. This Raffle is void wherever prohibited by law.
The following persons are NOT ELIGIBLE to participate in the Raffle or to win any Prize: Employees, officers, directors, shareholders, members, agents and consultants of the Red Sox Foundation, the Boston Red Sox, the MLB Entities (defined below), the printer of the Raffle tickets, The Josh Beckett Foundation, and any parent, subsidiary, affiliated entity, advertising agency, promotion agency and immediate family members of any Ineligible Party. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. , Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., MLB Network, LLC, the Major League Baseball Clubs, Tickets.com, Inc. and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. "Immediate family members" means spouses, parents, grandparents, children, grandchildren, and siblings (and any of their respective spouses) of an Ineligible Party.
PURCHASING RAFFLE ENTRIES: The price of Raffle tickets will be $5 each. There are no discounts or complementary Raffle tickets. There are two (2) ways to purchase Raffle tickets:
(1) Raffle tickets may be purchased online ONLY by residents of Massachusetts age of 18 years or older for five dollars ($5) each starting at 9:00 p.m. ET on Friday, May 21, 2010 until 12:00 p.m. ET on Tuesday, July 6, 2010 at noon (or until the maximum number of Raffle tickets are sold out, whichever is first) by visiting www.redsox.com/Beckett and following the rules and directions to purchase and print a Raffle ticket.
To be valid, a raffle ticket purchased on www.redsox.com/Beckett must be downloaded from the website and printed by the eligible entrant at the time of purchase. Entrants purchasing Raffle tickets online must digitally sign their Entries, using the procedures specified. All purchasers of Entries must provide their names, telephone number and (if available) e-mail address at the time of purchase.
(2) Raffle tickets will be available for purchase in person by eligible persons (see "ELIGIBILITY TO ENTER" above) at Fenway Park at select locations before and through the 3rd inning of home games from Thursday, May 27th to noon on Tuesday, July 6th 2010 (or until the maximum number of Raffle tickets are sold out, whichever comes first). Eligible patrons who purchase their Raffle tickets in person at Fenway Park and other in person sales locations must sign their raffle ticket stubs at the time of purchase. Official Rules are available at Fenway Park, on redsox.com, on redsoxfoundation.org and other points of sale and should be read before Raffle ticket purchase.
Sponsor shall be the sole judge of the validity and eligibility of all Entries. Entries generated by other automated or mechanical means are void. Entries which are or appear to be tampered with are void. All Raffle Ticket purchases shall be final, and no refunds or replacements will be issued by Sponsor. Official Rules are available on www.redsox.com and at Fenway Park and should be read before Raffle ticket purchase. Online Raffle ticket purchases are restricted ONLY TO MASSACHUSETTS RESIDENTS 18 YEARS OR OLDER. Based on Sponsors determination, Raffle tickets purchased by individuals and through means that are not in compliance with these rules may be considered void and ineligible for Prizes. To be valid, all raffle Entries, regardless of method or location of purchase, must be purchased no later than noon on Tuesday, July 6th. No portion of the Raffle ticket price may be deducted as a charitable contribution for federal income tax purposes.
MAXIMUM NUMBER OF RAFFLE TICKETS: A maximum total of 19,000 Raffle Tickets will be sold. If 19,000 Raffle tickets available are sold before noon on Tuesday, July 6th the Raffle shall be deemed "sold out" and no additional Raffle tickets will be sold. If the Raffle is sold out earlier than the Tuesday, July 6th the Drawing will still occur on Tuesday, July 6th as stated in these Rules (See "Drawing"). There is no minimum number of Raffle tickets that must be sold.
ODDS: The odds of winning a Prize depend on the number of eligible Entries received. If the maximum 19,000 Raffle tickets are sold, the odds of winning for each Raffle ticket are 19 in 19,000. If less than the maximum Raffle tickets are sold, the odds of winning will be greater. A maximum of one Prize per winner will be awarded.
TRANSFER OF RAFFLE ENTRIES: Persons who purchase Raffle tickets in person at Fenway Park or other designated in person sales locations may opt to give away their Raffle tickets to others, but in doing so they give up any claim they might otherwise have to the Prizes if they surrender a winning Raffle ticket. Raffle tickets purchased in person may be given away to persons who are under 18 years of age, but only individuals who are 18 years of age or older may claim or win a Prize.
Due to legal restrictions, raffle tickets purchased online at www.redsox.com may NOT be given away or otherwise transferred. The Raffle is being conducted pursuant to a raffle permit issued to Sponsor by the City of Boston.
Purchasers of Raffle tickets, whether purchased at Fenway, other designated locations or on www.redsox.com, may not re-sell their Raffle tickets to other parties, and may not knowingly give such Raffle tickets away to others for the purpose of allowing those other parties to re-sell such Raffle tickets. All Raffle tickets which have been resold in violation of these Official Rules shall be void.
DRAWING: Potential winners will be selected in a random drawing from eligible Entries received (the "Drawing"). The Drawing will be held at Fenway Park in Boston, MA on Friday, July 9th at 10a.m. ET. If for any reason whatsoever the Drawing cannot be held on Friday, July 9th, the Drawing will be held on Saturday, July 10th. The winning Raffle ticket numbers will be announced by Sponsor at the Drawing.
The winning Raffle ticket numbers will also be displayed on www.redsoxfoundation.org and on www.redsox.com/Beckett after the Drawing until Saturday, July 31st.
For those without internet service, the winning numbers will also be available on sheet of paper at the Red Sox Ticket Office from Friday, July 9th until Saturday, July 31st during regular business hours. However, as provided below under "NOTIFICATION OF POTENTIAL WINNERS," owners of winning Raffle ticket numbers have only until Friday, July 16th at 4pm ET the latest to present their winning Raffle tickets to claim their Prizes, even though the winning numbers may continue to be announced on websites or otherwise posted. Sponsor shall draw additional numbers if needed before Saturday, July 18th until 19 valid winners are selected.
NOTIFICATION OF POTENTIAL WINNERS: Owners of eligible entries need NOT be present in person at the Drawing in order to win. Sponsor will try to contact the purchasers-of-record of the 19 winning entries ("Potential Winners") by mail, phone or email immediately after the Drawing, to notify them that they are Potential Winners, but only if and to the extent that Sponsor can successfully identify and contact such Potential Winners based on the identifying and contact information supplied by the purchasers of the Entries in question. It is not the Sponsors responsibility to contact owners of winning tickets
WHETHER OR NOT CONTACTED BY SPONSOR, EACH POTENTIAL WINNER MUST CONTACT SPONSOR DIRECTLY TO BEGIN THE AUTHENTICATION PROCESS REQUIRED TO CLAIM HIS/HER PRIZE BY CONTACTING THE SPONSOR VIA EMAIL AT redsoxfoundation@redsox.com OR BY CALLING THE RED SOX FOUNDATION AT (617) 226-6440 BETWEEN THE HOURS OF 11AM AND 4PM BETWEEN FRIDAY, JULY 9TH THROUGH 4PM ON JULY 16TH.
TO MAKE OTHER ARRANGEMENTS, SPONSOR MUST BE ABLE TO INSPECT IN PERSON AND VERIFY THE AUTHENTICITY OF CLAIMANT'S PUPORTED WINNING RAFFLE TICKET BEFORE 4PM ON FRIDAY, JULY 16TH FOR ANY TICKET TO BE CONSIDERED VALID.
DETERMINATION OF OFFICIAL WINNER(S): Sponsor shall have the sole discretion to determine whether each Potential Winner is an official winner of a Prize (an "Official Winner"). Sponsor's decision concerning the identity of all Official Winners shall be final and binding. To become an Official Winner: (1) a Potential Winner must be eligible to participate in the Raffle under these Official Rules and must not be in violation of these Official Rules as determined in Sponsor's sole judgment; (2) that Potential Winner must contact Sponsor, or be contacted by Sponsor, by the deadline specified above under "NOTIFICATION OF POTENTIAL WINNERS"; (3) that Potential Winner's winning entry must be inspected and verified in person by Sponsor by the deadline specified above; (4) that Potential Winner must execute and return to Sponsor an affidavit of eligibility on a form to be provided by Sponsor before the Prize is awarded; and (5) that Potential Winner must provide Sponsor with all tax identification information required by federal, state or local law and, where applicable, provide Sponsor with payment for any required withholding taxes due prior to that Potential Winner's receipt of the Prize. If for any reason whatsoever all of the foregoing requirements are not satisfied with respect to a particular Potential Winner, or if Sponsor is unable for any reason to identify the holder of a winning Raffle ticket or to contact a Potential Winner, then that Potential Winner's Prize will be deemed forfeited and, at Sponsor's sole discretion, an alternate Potential Winner and Official Winner of that Prize will be selected, through another random drawing from the remaining pool of eligible Entries.
Sponsor shall use the following rules to determine the identity of any Potential Winner and of the Official Winner of each Prize: (1) in the case of a Raffle ticket that was purchased at www.redsox.com, Sponsor shall conclusively presume that the purchaser of that Raffle ticket, as determined by credit-card purchase records, is the lawful owner of that Raffle ticket and that Raffle ticket's winning number and (2) in the case of a Raffle ticket that was purchased in person at Fenway Park or another specified in person sales venue, Sponsor shall conclusively presume that the person who is in possession of that Raffle ticket is the lawful owner of that Raffle ticket and that Raffle ticket's winning number, and Sponsor shall not make, nor have any duty to make, any inquiry whatsoever into the circumstances under which that person came into possession of such winning Raffle ticket. In the unlikely event that an error or problem in the administration of the Raffle results in two (2) or more Raffle ticket purchasers holding winning Raffle tickets that contain identical Raffle ticket numbers, then the person who has record of the earliest Raffle ticket purchase shall be deemed to hold the winning Entry.
AWARD OF 19 PRIZE(S) TO OFFICIAL WINNER(S): A Prize will be awarded to each Potential Winner who has been designated by Sponsor as an Official Winner up to the limit of 19 Prizes. All Prizes may be redeemed by the Official Winners at Fenway Park at time and date to be arranged by the Red Sox Foundation.
Each Official Winner shall be solely responsible for his/her own transportation and other to collect travel costs associated with his/her attendance or delivery of their prize.
TAXES: All federal, state and local income taxes are the sole responsibility of each Raffle winner. The taxable value of the Prize may be treated as ordinary income to the winner for federal and state income tax purposes, and each winner will be required by law to pre-pay a portion of the tax liability incurred in connection with his/her receipt of the Prize before receiving his/her Prize from Sponsor.
GENERAL CONDITIONS: The Released Parties (defined below under "RELEASE OF LIABILITY") are not responsible for: (1) Entries which are stolen, lost, damaged, illegible, given away or no longer in the purchaser's possession, (2) Entries that have been or may have been tampered with or re-sold in violation of these Official Rules; (3) Entries or payments that are delayed, misdirected, undelivered, not fully captured, or garbled as a result of any failure or problem whatsoever with the availability, functionality, operability or use of any network, server, ISP, website, Internet connection, computer, telephone, cable or satellite modem or connection, hand held mobile device or any other computer equipment or connection, whether or not caused by site users, tampering, hacking, or by viruses, worms, or malfunctions affecting a network, server ISP or any equipment or programming used in or associated with the Raffle; (4) the inability of a purchaser or prospective purchaser of an Entry to connect or stay connected to the Internet, to log on to any website, or to participate in or complete any online communication or activity related to the Raffle; (5) any other errors of any kind, whether human, typographical, printing, mechanical, or electronic in nature, which relate to or are connected with the Raffle (collectively, as described in clauses (1) through (5), "Errors"), including without limitation Errors in Raffle-related materials or in the administration of the Raffle, such as Errors in processing Entries, identifying Potential Winners, determining Official Winners, or announcing or delivering Prizes; or (6) any injury or damage to any person's computer equipment related to or resulting from participation in this Raffle, the use of any website associated with the Raffle, or the downloading of any materials from such website(s). Anyone who tampers with or abuses the downloading of any aspect of the Raffle or associated website, as determined in Sponsor's sole judgment, will be disqualified from participation in the Raffle and if applicable, will be deemed to have forfeited all claims to any Prize. If any portion of the Raffle is compromised, in Sponsor's sole judgment, by a virus, worm, bug, non-authorized human intervention or other causes which, in Sponsor's sole judgment, corrupt or impair the administration, security, fairness or proper play of the Raffle, or the proper submission or capture of Entries (collectively, a "Compromising Event"), then Sponsor reserves the right, in its sole discretion, to suspend, modify or terminate the Raffle, and to select winners from all eligible, non-suspect Entries received before the known occurrence or discovery of such Comprising Event.
RELEASE OF LIABILITY: Entrants, by participation in the Raffle, agree that the Ineligible Parties and each of their respective parents, affiliates, subsidiaries, partners, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, shareholders, members, consultants and agents (collectively, the "Released Parties") will have no liability whatsoever for, and shall be held harmless by entrants against, any liability for injuries, losses, cost, expenses or damages of any kind, including damages for death, personal injury, property damage or property loss, or other harm resulting from, whether in whole or in party or directly or indirectly, participation in this Raffle or the acceptance, possession, misuse or use of any Entry or Prize, rules and their application thereof, all means of Raffle ticket sales, Raffle process, and/or winning Raffle ticket selection.
PUBLICITY RELEASE: Each Official Winner, by accepting his/her Prize, grants Sponsor and Sponsor's designees and affiliates, including the Boston Red Sox, full permission, except where legally prohibited, to use that Official Winner's name, address (city and state only), photograph, voice and/or other likeness and Prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide, and on the Internet and world wide web, in perpetuity.
COPYRIGHT: All Raffle materials are copyrighted by Sponsor, and may not be copied, reproduced or used for any purpose without Sponsor's express prior written consent.
GOVERNING LAW; SEVERABILITY: The Raffle and these Official Rules shall be subject to and governed by the laws of the Commonwealth of Massachusetts. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules, and the application of all of these Official Rules to other persons or circumstances, shall not be affected by that determination, and shall remain enforceable to the fullest extent permitted by law. DEPOSITING RAFFLE TICKETS OR RELATED MATERIALS IN THE FEDERAL MAILS IS A VIOLATION OF FEDERAL LAW AND COULD LEAD TO CRIMINAL PENALTIES.
